Tallahassee, Fla. -Senator Carey Baker announced
today that Senate Bill 96, Florida's 10th Amendment resolution,
has successfully passed out of the Senate Judiciary Committee. The
legislation, which seeks to reaffirm Florida's legislative
sovereignty under the United States Constitution's 10th
Amendment, passed the Judiciary Committee by a vote of 6 to 2.
'Washington's policymakers need to be reminded that the
10th Amendment protects states from the inappropriate exercise of
federal power,' Baker said. 'Unfortunately, Congress
continues to assert jurisdiction over matters in which they have no
clear constitutional authority. We need to protect our 10th
Amendment right to govern our own affairs because Florida's
legislators are better able to address issues affecting Floridians
than bureaucrats in Washington, D.C.'
The Tenth Amendment to the United States Constitution reads as
follows: 'The powers not delegated to the United States by
the Constitution, nor prohibited by it to the States, are reserved
to the States respectively, or to the people.' To date, 38
states have introduced legislation similar to Senator Baker's
in an attempt to restore the proper constitutional balance of power
between the state and federal governments.
The legislation will now be forwarded to the Senate
Rules Committee for further consideration.
Now it's going to go to the next step. The
legislation will now be forwarded to the Senate Rules Committee for
further consideration. There are 20 Senators on the Rules
Committee, 13 Republicans, 7 Democrats. I would suggest to all you
Floridians that if you recognize any of them as your Senators in
your district, CONTACT them and let them know that you want them to
follow the other 38 states and protect us against the Federal
Government and reaffirm Florida's legislative sovereignty under
the United States Constitution's 10th Amendment.
